Terms and Conditions

By booking a course, class, or activity with Freedive Aotearoa, you agree to the following terms and conditions.

Participation Requirements

Freediving involves inherent risks. All participants must be 18 years of age or older (or have written parental/guardian consent), be a competent swimmer, disclose any medical conditions that may affect their ability to freedive safely, and complete our health declaration form prior to participation.

Health & Medical Requirements

Freediving is a physically demanding activity. You must not participate if you have any condition contraindicated for breath-hold diving, including cardiovascular conditions, respiratory conditions, epilepsy, or recent surgery. We reserve the right to refuse participation to any person we deem medically unfit or at risk.

Assumption of Risk & Liability Waiver

Freediving carries inherent risks including injury or death. By participating in any Freedive Aotearoa activity, you acknowledge these risks and agree to participate at your own risk. To the maximum extent permitted by New Zealand law, Freedive Aotearoa, its instructors, and staff shall not be liable for any injury, loss, or damage arising from your participation. This does not exclude liability for negligence where prohibited by the Consumer Guarantees Act 1993 or other applicable legislation.

Code of Conduct

All participants are expected to behave respectfully towards instructors, other students, and the ocean environment. We reserve the right to remove any participant who behaves in a manner that endangers themselves, others, or the environment, without refund.

Equipment

Participants are responsible for the care of any equipment provided by Freedive Aotearoa. Damage to equipment due to negligence or misuse may be charged to the participant.

Photography & Media

Freedive Aotearoa may photograph or film activities for promotional and educational purposes. By participating, you consent to the use of your image in such materials unless you notify us otherwise in writing before the activity begins.

Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be resolved in accordance with New Zealand law.
